ARTICLE 2 – APPLICABILITY AND ELIGIBILITY

  2. By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or country of residence, or that you have given us your consent to allow any of your minor dependents to use this site.


ARTICLE 3 – PRODUCTS, OFFERS AND PRICING

  1. All prices listed on our website for EU customers include value-added tax (VAT) at the prevailing rate.

  2. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue any product or service without prior notice.

  3. We cannot be held to offers or prices that are obviously incorrect or contain manifest errors (e.g., system glitches displaying a price of €0.00). In such cases, we reserve the right to cancel the order.

  4. We have made every effort to display as accurately as possible the colors, materials, and images of our products. We cannot guarantee that your device’s display of any color will be completely accurate.


ARTICLE 4 – PAYMENT AND ORDERS

  1. A binding contract is formed once you complete the checkout process and receive an automated order confirmation via email.

  2. We accept various payment methods as displayed during the checkout process. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

  3. For orders placed outside the European Union, import duties, taxes, and customs fees may apply upon arrival in the destination country. These additional charges are the sole responsibility of the customer, unless otherwise stated.


ARTICLE 5 – SHIPPING AND DELIVERY

  1. We will deliver the goods to the delivery address specified in your order.

  2. Estimated delivery times provided on our website are indicative only. Delayed delivery does not automatically entitle you to compensation or cancellation, provided the shipment occurs within 30 days of order placement, unless agreed otherwise.

  3. The risk of damage to or loss of products remains with Boldwill until the product has been delivered to the customer or a representative designated by the customer.


ARTICLE 6 – RIGHT OF WITHDRAWAL AND RETURNS

  1. You have the legal right to cancel and return your purchase within 14 calendar days from the day after you (or a third party designated by you) receive the goods, without giving any reason.

  2. During the withdrawal period, you must handle the product and its packaging with care. You may only unpack or use the product to the extent necessary to inspect its nature, characteristics, and functioning (similar to trying on clothes in a physical store). All items must be returned unwashed, unworn, undamaged, and with original tags attached.

  3. Unless explicitly stated otherwise, the direct costs of returning the product to our warehouse are borne by the customer. Detailed instructions and rates are available on our Shipping and Returns page.

  4. If you exercise your right of withdrawal, Boldwill will refund all payments received from you (including standard delivery costs of shipping the item to you) without undue delay and at the latest within 14 days from the day on which we are informed of your decision or receive proof/delivery of the returned goods. We will process refunds using the same payment method as used for the initial transaction.


ARTICLE 7 – LEGAL GUARANTEE (WARRANTY)

  1. Under European consumer law, you are entitled to a legal guarantee of conformity. This means that a product must meet reasonable expectations and perform as advertised.

  2. If a product arrives damaged or develops a manufacturing fault within a reasonable period, please contact us at info@boldwill.com with photos and proof of purchase so we can arrange a repair, replacement, or refund.

  3. Damage resulting from normal wear and tear, improper washing/care, accidental damage, or unauthorized modifications is excluded from guarantee claims.


ARTICLE 8 – INTELLECTUAL PROPERTY

  1. All content on this website, including but not limited to brand names, trade marks, text, design, graphics, logos, images, photography, and software, is the property of Boldwill and is protected by international copyright and intellectual property laws.

  2. You may not reproduce, duplicate, copy, sell, or exploit any portion of the site or products without express written permission from Boldwill.


ARTICLE 9 – LIMITATION OF LIABILITY

  1. Boldwill shall only be liable for direct damages resulting from intentional misconduct or gross negligence attributable to us.

  2. To the maximum extent permitted by applicable law, Boldwill shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, our products or website.

  2. In accordance with European regulation, European consumers may also submit disputes to the European Commission's Online Dispute Resolution (ODR) platform.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of The Netherlands. Any disputes shall be submitted to the jurisdiction of the competent court in The Netherlands.
